THE TERMS AND CONDITIONS THAT APPLY TO ALL GOODS AND SERVICES SUPPLIED BY TCTOUCH IT SOLUTIONS.

IT IS IMPORTANT THAT YOU READ THESE TERMS AND CONDITIONS BECAUSE THEY INCLUDE EXCLUSIONS AND DISCLAIMERS IN RESPECT OF LIABILITY AND LOSS ARISING FROM THE GOODS AND SERVICES SUPPLIED BY TC TOUCH IT SOLUTIONS.

GENERAL
We reserve the right to change these terms and conditions at any time. Any such changes will take effect when posted on the website and it is your responsibility to read the terms and conditions on each occasion you use this website and your continued use of the website shall signify your acceptance to be bound by the latest terms and conditions.
All contracts formed between TCTouch IT Solutions and users shall be governed by, and construed in accordance with English Law. Any disputes not resolved by the normal complaints procedure will be resolved exclusively in the courts of England & Wales under English Law. These terms and conditions do not affect your statutory rights.
All trade marks reproduced in this website which are not the property of, or licensed to, the operator are acknowledged on the website.
Unauthorised use of this website may give rise to a claim for damages and/or be a criminal offence.
We do not accept any responsibility for any web site not under our control, which may act as a portal for our site, or be connected by hypertext links from our site.

Repairing

1. We offer a comprehensive 90 days repair warranty unless otherwise stated on the repair page. If during this time the same problem re-surfaces we will repair the issue at no extra cost to the customer and if this is not possible a refund will be issued (after inspection) less our admin fee of £25 and postage costs. Warranty does not cover new faults that surface after a repair is completed.

2. The warranty on any hardware will be voided if any sticker placed on the warrantable equipment is removed, broken, tampered with or if the computer has been opened by anyone other than TCTouch IT Solutions.
3. Equipment is only covered for faulty workmanship on parts, and for parts that fail due to manufacturing defects recognised by the component manufacturer. This warranty does not cover failure of equipment due to the system not being serviced adequately, or failure from “fair wear and tear”.
4. The warranty does not cover repairs for the replacement parts due to incompatibility. The warranty holder will be liable to pay for these repairs.
5.  Damage to a system or components, supplied by TCTouch IT Solutions, caused by power surges or spikes, including and not limited to, mains power and telecommunications connections, or to other unspecified sources, voltage fluctuation, amperage fluctuation, rust or corrosion, are not covered under warranty.
6. Warranties do not cover loss or damage due to negligence, accidents, theft, flood, fire, earthquakes, electrical storms or any other act of God or any war related events.
7. TCTouch IT Solutions reserves the right to suspend or cancel warranties for failure to pay monies owing to TCTouch IT Solutions as a result of non-warranty work being carried out on a system at the request of the warranty holder.
8. Completion dates for repairs are estimated and depend on the availability of parts.While we make every effort to meet these timescales, we cannot be held responsible for delay, however caused. Repaired hardware will be stored for up to two months after the customer has been notified of completion. After this time, they may be disposed of and any disposal proceeds will belong to TCTouch IT Soltuions. All replacement parts are covered by a 90 day warranty. TCTouch IT Solutions is not an Apple Authorised Service Provider.
9. TCTouch IT Solutions will not issue a refund on any device without physical inspection. All faulty items under repair warranty must be returned by the customer to us for inspection and confirmation of the fault before a refund can be issued.
10. Any repair performed on an item under warranty whereby no fault can be found, or the fault is not covered under warranty (i.e. software, virus, end user error or other non-warranty cause herein stated) a ‘No Fault Found’ fee may be payable by the warranty holder at the usual rate. TCTouch IT Solutions will only charge for any additional parts that may be required.
11. Sales to businesses are not subject to consumer laws and returns will be handled on a case by case basis. Unless otherwise specified in writing, TCTouch IT Solutions is not responsible for covering the costs of return shipment of any goods.

Purchasing

1. We have the right, at our discretion, to refuse to supply goods you order.
2. Goods are subject to availability. If we do not supply the goods we will refund any money already paid. We will not be liable for compensation or damages if we do not supply goods.
3. We aim to deliver any goods within the estimated delivery time frame; however, deliveries may be subject to conditions outside of our control.
4. In the occurrence of misdelivery or damage during delivery TCTouch IT Solutions limits liability to that of the amount covered by the insurance provided by the courier company.
5. Please check the goods on delivery. If goods are delivered damaged or faulty you must inform us within 7 days of delivery and we will arrange collection and replacement at our cost. If you do not inform us within 7 days we shall have no liability for goods said to be damaged on delivery. This does not affect your statutory rights.
6. You will own the goods when payment is received in full and the item has been received.  You will be responsible for the goods once delivery is made or delayed by you at delivery.
7. To return goods please follow the returns procedure detailed under the Warranty Terms and Conditions. We do not accept liability for the costs of return, returns damaged in transit or not received by us. Refunds may incur a restocking fee and exclude postage and packaging fees and any advertising fees.
8. Every care has been taken in the preparation of any offer. However, as far as is permitted by applicable law, we disclaim all warranties, express or implied as to the accuracy of information contained
9. Parts supplied by TCTouch IT Solutions are either brand new, pre-owend or refurbished, unless otherwise stated. All brand new parts supplied, comes with the original equipment manufacturer’s warranty which normally is within the range of 1 to 5 years and starts from the date the item was purchased by TCTouch IT Solutions.

14. In any event of refunds as a result of buyer changing mind, a re-stocking fee of 10% will be deducted from the total amount refunded and the customer must notify us within 7 working days.

Disclaimer

TCTouch IT Solutions customers shall back up all data stored in the products to be repaired and remove any removable media, such as diskettes, CDs, DVDs or PC Cards before returning or submitting the products for repair or replacement. TCTouch IT Solutions does not accept any liability for data or software, which is lost, corrupted, deleted or altered during repair. Customer accepts full responsibility for Customer software and data and TCTouch IT Solutions are not required to advise or remind customers of appropriate backup and other procedures. TCTouch IT Solutions will not be liable for any damage caused to other equipment by Goods supplied. TCTouch IT Solutions does not accept responsibility for any damage resulting from viruses or other malicious pieces of software that may have been transmitted during servicing or escaped detection.TCTouch IT Solutions have permission from the customer to replace assemblies or components with devices of similar, or better, design and capability.
The customer understands and accepts that some applications may no longer work properly after a repair, due to the installation of different hardware or software. It is the customer’s responsibility to reconfigure or reinstall any such applications.
TCTouch IT Solutions have permission from the customer to carry out the work on the equipment in need of repair.
